If you are in a long-term, committed relationship with a British citizen or a person with settled status in the UK—but are not married—you may be eligible to apply for an Unmarried Partner Visa. This visa provides a path to live, work, and build your future together in the UK.
At HM & Co. Solicitors, we specialise in family-based immigration and understand the importance of handling relationship applications with care, discretion, and attention to detail. Whether you are applying for the first time or challenging a refusal, our dedicated team will manage every aspect of your case with a tailored, personal approach.
We believe that no two couples are alike—so neither should their applications be. From gathering evidence of cohabitation to drafting persuasive legal arguments, we help present your relationship clearly and genuinely to the Home Office.
The Unmarried Partner Visa is available to both heterosexual and same-sex couples who have lived together in a relationship akin to marriage for at least two years prior to the application. This route falls under the UK’s Family Visa category.
You do not need to be married or in a civil partnership to qualify—but you must demonstrate the seriousness and durability of your relationship.
Outside the UK: Visa is typically granted for 33 months
Inside the UK: Visa is issued for 30 months
Extensions: Available for a further 30 months
Permanent Residency: After five continuous years on this route, you may be eligible for Indefinite Leave to Remain (ILR)
To apply successfully, applicants must satisfy several key requirements:
You must show that you have lived together in a committed relationship for approximately two years. Where this is not possible due to exceptional circumstances (e.g. work postings abroad, travel restrictions, cultural sensitivities), we can help you build a robust case explaining your situation.
Your UK-based partner must earn at least £29,000 per annum
If you’re applying from within the UK, both partners’ incomes can be combined to meet the threshold
If you don’t meet the income requirement through earnings, savings may be used as an alternative
You must provide evidence that you and your partner have or will have adequate accommodation in the UK which meets housing standards and is not overcrowded.
The applicant must demonstrate their ability to speak and understand English. This is usually achieved by passing an approved English language test, unless they are exempt by virtue of nationality or academic qualifications.
The UK-based partner (the sponsor) must be either:
A British Citizen
Settled in the UK (e.g. holding Indefinite Leave to Remain or Pre-Settled Status under the EU Settlement Scheme)
A recognised refugee or granted humanitarian protection

The Home Office typically aims to process applications within 12 weeks (approximately 3 months) from the date of submission. However, if you’re applying in a time-sensitive situation, there are priority services available:
Inside the UK: You may be eligible for a 24-hour Super Priority Service
Outside the UK: A Priority Visa service can return a decision in around 30 working days
We can advise you on eligibility and arrange priority processing where appropriate.
As of the latest guidance:
Outside the UK: £1,523
Inside the UK (switching visas): £1,033
These fees are payable directly to the Home Office. For our legal fees and assistance with preparing a strong application, we offer a free initial consultation—please get in touch for a bespoke quote based on your circumstances.
To qualify for the visa, you must:
Have been living together in a committed relationship for at least two years
Show that your relationship is genuine and subsisting
Meet the financial requirement (currently £29,000 for the sponsor)
Demonstrate adequate accommodation in the UK
Satisfy the English language requirement
If you fall short in any of these areas, particularly with cohabitation or financial evidence, we encourage you to speak to one of our solicitors for tailored legal advice.
We understand that many couples face challenges in meeting the two-year cohabitation rule—whether due to work or study commitments, cultural considerations, or international travel restrictions.
At HM & Co. Solicitors, we have successfully obtained visa approvals for numerous clients where discretion was exercised by the Home Office. If exceptional circumstances apply to you, we’ll help build a strong case to support your application.
If you are:
Married or in a civil partnership, you should apply for the UK Spouse Visa, which has similar requirements but does not require proof of two years’ cohabitation.
Planning to marry soon, you may wish to apply for a Fiancée Visa, which allows you to enter the UK, marry your partner within 6 months, and later switch to the Spouse Visa category.
Our team can advise on the most suitable route for your relationship and long-term goals.
We understand that each relationship is unique. If you're unsure which visa route is right for you, or if your case presents any complications, our team is here to help. Contact HM & Co. Solicitors for expert, confidential, and compassionate support.
