Who Can Apply for a Spouse Visa?
To qualify, you must be:
Married to or in a civil partnership with a British citizen or someone who holds settled status (Indefinite Leave to Remain)
Able to prove that your relationship is genuine and ongoing
Meeting the financial requirements set out by the Home Office
Able to demonstrate your English language ability (unless exempt)

How long do I need to be married before applying for a UK Spouse Visa?
There is no minimum length of marriage required. You can apply as soon as you are legally married. In many cases, we begin preparing the visa application while the couple is still planning their wedding, so it’s ready for submission immediately after the ceremony.
Can I apply if I’ve only recently married?
Yes, newlyweds are welcome to apply. The key requirement is that the relationship is genuine and that the marriage is legally recognised.
How much must I earn to sponsor my partner under the Spouse Visa route?
As of 2024, the minimum income threshold is £29,000 per year. This figure can be higher if you are also applying with dependent children. If you do not meet the income requirement through employment alone, you may be able to rely on savings.
Can savings be used to meet the income requirement?
Yes, savings over £16,000 can be used to meet or supplement the income threshold. Our team can advise you on the exact calculation.
What should I do if my previous Spouse Visa application was refused?
You can reapply immediately. We regularly assist clients whose applications were previously refused by carefully addressing the Home Office's concerns and submitting a stronger application. It’s important to act promptly and ensure the new application is thoroughly prepared.
What happens if my relationship breaks down while I’m on a Spouse Visa?
To be granted a Spouse Visa, your marriage must be genuine and ongoing at the time of application. If your relationship breaks down while you hold the visa, your status may be affected. However, there are alternative routes available depending on your circumstances, especially in sensitive cases. How long before I can apply for British citizenship on a Spouse Visa?
After five years on a Spouse Visa, you may be eligible to apply for Indefinite Leave to Remain (settlement). One year after being granted ILR, you can usually apply for British nationality, provided you meet the other requirements.

Shocked and surprised!
I entered the HM & Co Solicitors on Lower Road in what can only be described as a highly agitated state. I had been told a variety of information from another company and had been told I needed services from a solicitor. After explaining my situation to the gentleman I now know as Mr Hakeem Ayantayo (solicitor) he advised me that I did not need his services and to offer them to me for monetary gain would be against good public practise. He offered me friendly advice and even briefly spoke on the phone to the other company who were trying to make things difficult for me. Ultimately the situation I was in was resolved due to Mr Ayantayo and his due diligence. Mr Ayantayo could have taken advantage of my ignorance and lack of lawful knowledge but instead showed me kindness and support all while not fleecing me! Which in this day and age is a rarity!
