If you’ve been living in the United Kingdom for many years but do not have official documentation to confirm your right to remain, you may be eligible to apply under the Windrush Scheme. This government initiative supports members of the so-called Windrush Generation, as well as their children and others, in securing their lawful status in the UK.
The scheme also provides a route for some applicants to receive compensation for losses they may have suffered due to being unable to prove their status.
You may be eligible to apply to the Windrush Scheme if any of the following apply:
You came to the UK from a Commonwealth country before 1 January 1973
Your parent(s) came to the UK from a Commonwealth country before 1973
You arrived in the UK from any country before 31 December 1988 and are now settled here
If you’re unsure whether you qualify, HM & Co. Solicitors can review your circumstances and provide clear guidance.
If you are applying from within the UK, the application must be completed in paper form and posted to the address listed on the form.
If you are applying from outside the UK, the process is online. You’ll need to fill in the relevant Windrush citizenship application form via the Home Office website and provide any supporting evidence required to show that you are eligible under the scheme.
We understand that navigating the Windrush Scheme can be complex—particularly when it comes to proving eligibility or providing sufficient documentation. At HM & Co. Solicitors, our experienced immigration lawyers can assist with:
Reviewing your personal and family history
Collating and submitting the appropriate documents

There are three main categories of people who may qualify for the Windrush Scheme:
Commonwealth citizens who arrived in the UK before 1 January 1973 and have the right of abode.
Children of Commonwealth citizens who settled in the UK before 1 January 1973, and who were either born in the UK or entered the UK as a minor (under 18 years of age).
Individuals of any nationality who settled in the UK before 31 December 1988 and currently hold settled status.
If you're uncertain whether you fall into one of these categories, our legal team at HM & Co. can provide a tailored eligibility assessment.
The Windrush application itself is relatively quick to complete—particularly if you have the necessary information and supporting documentation ready. Once your application has been submitted, the Windrush Taskforce will contact you with updates and may request additional evidence to support your case.
There is no fee to apply to the Windrush Scheme or the associated compensation scheme.
At HM & Co. Solicitors, we offer flexible, case-by-case pricing for our legal assistance. This ensures you're only charged for the work carried out, with no unnecessary costs. To discuss your situation in confidence, we offer a free initial consultation.
If your application is successful, you will receive official documentation confirming your permanent right to live, work, and study in the UK. In some cases, this may also include proof of British citizenship, which can be used when applying for employment, benefits, or housing.
The Windrush Compensation Scheme, introduced in April 2019, provides financial redress for individuals who suffered as a result of being unable to prove their right to live in the UK.
Compensation covers a range of issues, including:
Wrongful deportation: fixed award of £10,000
Unlawful detention: compensation based on length of detention
Loss of access to housing or employment: awards starting at £1,000
Each case is assessed individually. The amount of compensation awarded depends on the type and extent of the harm experienced.
Yes. In addition to helping clients secure legal status or proof of citizenship under the Windrush Scheme, our team also provides full support with Windrush Compensation Scheme claims.
We’ll guide you through the process, ensure all relevant evidence is submitted, and represent your interests to the highest professional standard.
If you're affected by the Windrush scandal or believe you may be eligible under the Windrush Scheme, please don’t hesitate to get in touch. Our immigration solicitors are here to support you with both citizenship applications and compensation claims.
